In addition, participants agree to adhere by the following: Participants over the age of 18 and the parents or legal guardians of participating individuals and primary contacts for participants under 18 agree to defend, indemnify and hold harmless American Apparel, its officers, directors, agents, subsidiaries and affiliates wherever situated against any and all claims, losses, penalties, causes of action, damages, liability, costs, expenses (including but not limited to reasonable attorneys’ fees) or claims caused by or resulting indirectly from your participation in the contest, without limitation or exception, including your violation of any third-party’s rights including, without limitation, infringement of any copyright trademark, service mark, trade secrets, right of privacy or publicity or any other third party right). Entry into the American Apparel Back to School Selfie Contest constitutes complete permission to American Apparel, to use, edit or modify all submissions (including names, pictures, and likenesses) for any and all of America Apparel’s purposes in its sole discretion. Such purpose may include but is not limited to advertising and trade (including but not limited to display on the American Apparel web sites or in American Apparel retail stores) in any manner or medium whatsoever or not at all, without further compensation, notification or approval, unless prohibited by law. If there are discrepancies between any disclosures or other materials made or provided by American Apparel and others and these rules, then any rules chosen at American Apparel’s sole discretion shall prevail and control. American Apparel is not responsible for any typographical or other error in the printing of the offer, administration of the promotion or in the announcement of winners. American Apparel is not responsible for lost, late, faulty, incorrect or damaged transmissions, incorrect announcements of any kind (whether human or electronic), technical hardware or software malfunctions or failures of any kind, including any injury or damage to any person’s computer related to or resulting from participating in or receiving, viewing or using any materials in connection with the promotion, lost or unavailable network connections, inability to access the website or any failed, incomplete, garbled or delayed computer transmission that may limit a user’s ability to participate in the promotion. American Apparel reserves the right to cancel or modify the promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by American Apparel, in its sole discretion. In the event of termination, a notice will be posted online and winners determined from submissions received prior to termination. In the event a dispute arises regarding a specific individual entitled to receive prize, an entry made by Internet will be declared made by the “authorized e-mail account holder.” “Authorized e-mail account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Participant may be requested to provide American Apparel with proof that the participant is the authorized e-mail account holder of the e-mail address associated with the account/submission. Any damage to the American Apparel Online Store web site will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Proof of submitting entries will not be deemed to be proof of receipt by American Apparel. Any use of robotic, automatic, programmed or the like methods of participation will void all such submissions by such methods.
